Allgemeine Geschäftsbedingungen (AGB) für den Online-Shop „Illari“
1. Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Bestellungen über den Online-Shop „Illari“ durch Verbraucher und Unternehmer.

2. Vertragsabschluss
Die Präsentation der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot dar, sondern eine unverbindliche Aufforderung zur Bestellung.
Durch Anklicken des Buttons „Jetzt kaufen“ geben Sie eine verbindliche Bestellung der im Warenkorb enthaltenen Waren ab. Der Kaufvertrag kommt erst durch unsere ausdrückliche Auftragsbestätigung oder den Versand der Ware zustande.
3. Preise und Versandkosten
Alle angegebenen Preise sind Endpreise.
Gemäss Kleinunternehmerregelung wird laut § 19 UStG keine Umsatzsteuer berechnet und ausgewiesen.
Zusätzlich zu den angegebenen Preisen können Versandkosten anfallen. Diese werden im Bestellprozess gesondert ausgewiesen.
4. Lieferung
Die Lieferung erfolgt innerhalb Deutschlands sowie in die angebotenen Versandländer.
Die Lieferzeit beträgt, sofern nicht anders angegeben, ca. 3–10 Werktage nach Zahlungseingang.
Sollte ein Produkt nicht verfügbar sein, behalten wir uns vor, die Lieferung nicht auszuführen. Bereits geleistete Zahlungen werden unverzüglich erstattet.
5. Zahlung
Folgende Zahlungsmethoden werden angeboten:

Die Belastung erfolgt unmittelbar nach Bestellung.
6. Eigentumsvorbehalt
Die Ware bleibt bis zur vollständigen Bezahlung unser Eigentum.
7. Widerrufsrecht
Verbrauchern steht das gesetzliche Widerrufsrecht zu.
Widerrufsbelehrung
Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag, an dem Sie oder ein von Ihnen benannter Dritter die Ware in Besitz genommen haben. Um Ihr Widerrufsrecht auszuüben, müssen Sie uns mittels eindeutiger Erklärung per E-Mail über Ihren Entschluss informieren.
Zur Wahrung der Frist reicht es aus, dass Sie die Mitteilung vor Ablauf der Widerrufsfrist absenden.
Folgen des Widerrufs
Im Falle eines wirksamen Widerrufs erstatten wir alle Zahlungen einschließlich der Lieferkosten unverzüglich und spätestens binnen vierzehn Tagen.
Die Rückzahlung erfolgt über dasselbe Zahlungsmittel, das bei der ursprünglichen Transaktion verwendet wurde.
Der Kunde trägt die unmittelbaren Kosten der Rücksendung.
8. Ausschluss des Widerrufs
Ein Widerrufsrecht besteht nicht bei:
- individuell angefertigten Produkten,
- personalisierten Schmuckstücken,
- versiegelten Waren, sofern die Versiegelung entfernt wurde und eine Rückgabe aus hygienischen Gründen ausgeschlossen ist.
9. Gewährleistung
Es gelten die gesetzlichen Gewährleistungsrechte.
Modeschmuck kann materialbedingt Gebrauchsspuren, Farbabweichungen oder Veränderungen durch Feuchtigkeit, Parfüm oder Hautkontakt aufweisen. Diese stellen keinen Mangel dar.
10. Haftung
Wir haften uneingeschränkt für Vorsatz und grobe Fahrlässigkeit.
Für leichte Fahrlässigkeit haften wir nur bei Verletzung wesentlicher Vertragspflichten und begrenzt auf den vorhersehbaren Schaden.
11. Urheberrechte
Alle Inhalte dieses Shops, insbesondere Fotos, Designs, Texte und Logos, sind urheberrechtlich geschützt.
Eine Verwendung ohne ausdrückliche Zustimmung ist nicht gestattet.
12. Datenschutz
Informationen zur Verarbeitung personenbezogener Daten finden Sie in unserer Datenschutzerklärung.
13. Schlussbestimmungen
Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts.
Sollten einzelne Bestimmungen dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

1. Scope
These Terms and Conditions (T&Cs) apply to all orders placed via the “Illari” online shop by consumers and businesses.

2. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
By clicking the “Buy now” button, you are placing a binding order for the goods contained in the shopping basket. The purchase contract is only concluded upon our express order confirmation or the dispatch of the goods.
3. Prices and delivery charges
All prices quoted are final prices.
In accordance with the small business regulation, no VAT is charged or shown pursuant to Section 19 of the German VAT Act (UStG).
In addition to the prices quoted, delivery charges may apply. These are shown separately during the ordering process.
4. Delivery
Delivery is available within Germany and to the countries listed for delivery.
Unless otherwise stated, the delivery time is approximately 3–10 working days after receipt of payment.
Should a product be unavailable, we reserve the right not to proceed with the delivery. Any payments already made will be refunded immediately.

6. Retention of title
The goods remain our property until full payment has been received.
7. Right of withdrawal
Consumers are entitled to the statutory right of withdrawal.
Cancellation policy
You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you took possession of the goods. To exercise your right of withdrawal, you must inform us of your decision by means of a clear statement sent by email.
To meet the deadline, it is sufficient for you to send the notification before the withdrawal period expires.
Consequences of withdrawal
In the event of a valid withdrawal, we will refund all payments, including delivery costs, without delay and at the latest within fourteen days.
The refund will be made using the same payment method used for the original transaction.
The customer shall bear the direct costs of returning the goods.
8. Exclusion of the right of withdrawal
The right of withdrawal does not apply to:
custom-made products,
personalised jewellery,
sealed goods, provided that the seal has been removed and a return is excluded for hygiene reasons.
9. Warranty
The statutory warranty rights apply.
Due to the nature of the materials, costume jewellery may show signs of wear, colour variations or changes caused by moisture, perfume
or show signs of skin contact. These do not constitute a defect.
10. Liability
We accept full liability for wilful misconduct and gross negligence.
In cases of slight negligence, we shall only be liable for breaches of material contractual obligations and limited to foreseeable damage.
11. Copyright
All content on this shop, in particular photographs, designs, texts and logos, is protected by copyright.
Use without express consent is not permitted.
12. Data Protection
Information on the processing of personal data can be found in our privacy policy.
13. Final Provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.

1. Ámbito de aplicación
Estas Condiciones Generales (CG) se aplican a todos los pedidos realizados a través de la tienda online "Illari" por consumidores y empresas.

2. Formalización del contrato
La presentación de los productos en la tienda online no constituye una oferta legalmente vinculante, sino una invitación no vinculante a realizar un pedido.
Al hacer clic en el botón "Comprar ahora", usted realiza un pedido vinculante de los productos incluidos en su carrito de compra. El contrato de compraventa se formaliza únicamente tras nuestra confirmación expresa del pedido o el envío de la mercancía.
3. Precios y gastos de envío
Todos los precios indicados son precios finales.
De conformidad con la normativa para pequeñas empresas, según el artículo 19 de la Ley alemana del Impuesto sobre el Valor Añadido (UStG), no se aplica ni se muestra dicho impuesto.
Los gastos de envío pueden ser adicionales a los precios indicados. Estos se mostrarán por separado durante el proceso de compra.
4. Entrega
Realizamos envíos dentro de Alemania y a los países a los que enviamos.
Salvo que se indique lo contrario, el plazo de entrega es de aproximadamente 3 a 10 días hábiles tras la recepción del pago.
Si un producto no está disponible, nos reservamos el derecho de no procesar el pedido. Cualquier pago ya realizado se reembolsará de inmediato.

6. Reserva de dominio

7. Derecho de desistimiento
Los consumidores tienen derecho legal de desistimiento.
Política de cancelación
Tiene derecho a desistir de este contrato en un plazo de 14 días sin necesidad de justificación. El plazo de desistimiento expirará a los 14 días desde el día en que usted, o un tercero distinto del transportista e indicado por usted, adquiera la posesión material del bien. Para ejercer su derecho de desistimiento, deberá comunicarnos su decisión mediante una declaración inequívoca por correo electrónico.
Para cumplir con el plazo, basta con que envíe su notificación antes de que finalice el plazo de desistimiento.
Consecuencias del desistimiento
En caso de desistimiento válido, le reembolsaremos todos los pagos recibidos, incluidos los gastos de envío, sin demora indebida y, en cualquier caso, en un plazo máximo de 14 días desde el día en que se nos informe de su decisión de desistir del contrato.
El reembolso se realizará mediante el mismo método de pago que utilizó para la transacción inicial.
El cliente correrá con los gastos directos de la devolución del bien.
8. Exclusión del derecho de desistimiento
El derecho de desistimiento no se aplica a:
productos hechos a medida,
joyería personalizada,
productos precintados si el precinto se ha roto y la devolución está prohibida por razones de higiene.
9. Garantía
Se aplican los derechos de garantía legales.
Debido a la naturaleza del material, la bisutería puede presentar signos de desgaste, variaciones de color o cambios causados por la humedad, el perfume o el contacto con la piel. Estos no constituyen un defecto.
10. Responsabilidad
Somos plenamente responsables por dolo y negligencia grave.
En caso de negligencia leve, nuestra responsabilidad se limita al incumplimiento de obligaciones contractuales esenciales y al importe de los daños previsibles.
11. Derechos de autor
Todo el contenido de esta tienda, en particular las fotos, los diseños, los textos y los logotipos, está protegido por derechos de autor.
Se prohíbe su uso sin autorización expresa.
12. Protección de datos
Encontrará información sobre el tratamiento de datos personales en nuestra política de privacidad.
13. Disposiciones finales
Se aplicará la legislación alemana, con exclusión de la Convención de las Naciones Unidas sobre los Contratos de Compraventa Internacional de Mercaderías (CISG).
Si alguna disposición de estos Términos y Condiciones resultara inválida, la validez de las demás disposiciones no se verá afectada.
